On July 12, Russia celebrates Fisherman's Day. The team of the Vostok-1 fishing collective farm in Primorsky Krai is in a great mood on the eve of their professional holiday. After all, the company is a leader among industry enterprises developing deep-sea fishing facilities. And one can deservedly be proud of his labor achievements.

The extraction of biological resources at a depth of more than two thousand meters last year amounted to 21,500 tons. At the end of 2014, the fishing collective farm achieved the largest crab catch in recent years - 6557.91 tons of deep-sea crabs; compared to 2013, the increase in catch was 54 percent, or 2310.5 tons, and the fish catch amounted to 15 thousand tons.

In 2015, the trend towards an increase in catches is only increasing due to the competent management of the crab fishing fleet. The first half of this year was a period of stabilization of the situation with deep-sea crab. The company fishes for so-called crabs from the family of deep-sea snow crabs, angulatus and japonicus, which live at depths of 1200 - 2000 meters. Vessels have achieved sustainable catches of 170 - 180 tons per month.

In recent years, the Primorsky fishing enterprise has become a record holder for cod production. Last year's catch was 3,041 tons, which is 690 tons more than in 2013. And most importantly: specialists from the Vostok-1 collective farm have discovered a new promising object - black grenadier, the taste of which is excellent. Research on black grenadier conducted by TINRO showed the longest line of essential amino acids of all existing fish species, which is extremely beneficial for the human body. This is an excellent dietary food especially for those who suffer from diseases of the cardiovascular system and gastrointestinal tract.

Black grenadier has enormous commercial, biological and financial potential, and one of the enterprise's priorities for the near future is to unlock this potential.

The Vostok-1 fishing collective farm has earned a reputation as a reliable, strong and worthy partner far beyond the Primorsky Territory, both in domestic and foreign markets. The authority has been earned over the years, because the company will soon celebrate quarter-century anniversary. And about 600 people work on its ships, who are the golden fund of the enterprise, giving their knowledge, experience and strength for the benefit of its prosperity and for the benefit of the development of the entire fishing industry of Russia.

Supplying goods to the American, Japanese, European and Asian markets, which are very demanding in terms of quality, Vostok-1 has highly qualified personnel in every link of the chain (extraction - processing - transportation - storage). The Vostok-1 fleet consists of 13 units, which are equipped with modern equipment. When processing catches, high-quality waste-free technologies are used, which make it possible to produce various products and increase the profitability of fishing activities. As part of the fleet renewal and replenishment program, in the near future the company plans to commission two longline units, which will increase annual fish catches and raise the development of deep-sea fish species to an even higher level.

JSC "Fishing Collective Farm "Vostok-1" asks for the help of the prosecutor's office in a situation related to the initiation of a criminal case against the company. Fishing owners distributed a press release in which they outlined their vision of this case. They also stated that due to the current situation they are forced freeze the project aimed at creating a new business within the Free Port of Vladivostok.The news agency PrimaMedia publishes the press release without changes.

"On May 16, 2017, an information message appeared on the website of the Far Eastern Customs Administration:

Criminal savings on customs duties.

“As a result of joint operational investigative activities, employees of the Far Eastern operational customs and the Office of the FSB of Russia for the Primorsky Territory identified cases of evasion of customs duties when exporting marine products - halibut and crab limbs. Over three years of criminal activity of the Vladivostok fishing company, the total amount of unpaid customs duties reached almost 24 million rubles. During the verification of operational information, a criminal scheme was established for the export of aquatic biological resources to the Republic of Korea at a reduced customs value. In order to implement this scheme in the territory South Korea a certain company was registered, the actual investor of which was one of the members of the board of directors of the fishing company. Foreign trade contracts were concluded with this affiliated (subsidiary) South Korean company for the supply of biological resources at prices “convenient” for the exporter. Based on the revealed facts of evasion of customs duties on an especially large scale, Vladivostok customs opened a criminal case under Part 2 of Art. 194 of the Criminal Code of the Russian Federation."

The management of the company RK "Vostok-1" thanks the press center of the management for their correctness, since the name of the fishing company was not indicated. However, we do not want to hide and report that criminal prosecution has been initiated against our company.

The company has already received several requests from the media. Facilities mass media correctly assumed that the legitimacy and legal activities of one of the oldest Far East private fishing companies. And since the company conducts its activities legally, transparently and law-abidingly, we present our vision of the allegedly “criminal activities”.

On March 22, 2017, a large group of FSB and customs employees conducted interviews and seized documents from the company’s office, although the company’s management was ready to provide them at the first request of operational employees.

On April 16, customs made an attempt to adjust the customs value upward in order to calculate customs duties in an inflated amount for the recently purchased and reconstructed ship "Chance 105". The vessel was purchased and modernized according to the fleet renewal program that the company has been implementing for the last five years. While the real cost of the vessel with refurbishment was $3 million, confirmed by documents, its customs value was unreasonably increased by the customs service to $8 million. However, the matter did not reach arbitration proceedings; the company proved with documents the illegality of the assigned customs payment. The ship was released after collecting the real, but not inflated, customs value.

On May 11, the office was searched again. Security forces, with the support of armed people, occupied the entire floor of the company. 18 FSB and customs officers took part. The general director was presented with a court order for a search in connection with the opening of a criminal case. All our specialists were expelled into the corridor, where they sat for most of the working day. The office was searched, computers and phones were confiscated, the company's managers, their offices, apartments, and cars were searched. The office's activities were paralyzed. Dates have been set for employee interrogations.

On May 12, the first interrogation of one of the members of the board of directors was conducted. He was presented with papers dated 2012, which he admitted were falsified. Judging by the documents presented, because these cannot be called documents, customs officers are operating with information from an anonymous “well-wisher” who, out of revenge, deliberately presented government agencies fabricated materials more than five years old.

According to the company's management, the supplier of "operational information" is one of the former senior employees. He was suspended due to complaints about his work. This employee specialized in foreign economic activity and he provoked a conflict of interests between the company and his personal interests; in the end, he stated that he had “sold” commercial information to “criminal elements” and the company was awaiting a raider takeover. According to our information, the former employee who passed on the “information”, having learned that customs had begun to operate, flew out of the Russian Federation. The company is ready to submit to the customs official data from a lawsuit characterizing the information provider as a person specializing in creating falsifications, substituting original texts for the purpose of blackmail and extortion.

It is worth noting that after the first visit of law enforcement officers on March 22, in April two ships of our company were arrested and subjected to thorough searches and inspections, but nothing criminal was discovered on the ships, although they were under arrest for a total of 17 days, the ships were released back to fishing. Please note that the military prosecutor's office, to which the fishing collective farm filed complaints, recognized these arrests as illegal and unfounded. 304 military prosecutor's office of the garrison Pacific Fleet found that the actions of officials of the Border Department, who made and agreed on decisions to arrest ships, do not correspond to the goals and objectives of the Administrative Legislation and do not meet the principles of legality.

These events and the fact that the FSB and customs promptly responded to information submitted by subjects completely unfamiliar to them indicate that there is a biased attitude towards our company. And despite the fact that the false “reports” are not confirmed, the persecution of Vostok-1 continues.

Regarding the claims currently being made regarding understatement of customs value. It is worth noting that over the previous four years, employees of the Far Eastern Customs Administration pursued a strange policy of assigning customs values ​​to product release declarations. The cost was constantly adjusted towards a significant increase in customs value. The fishing collective farm had to pay a lot of extra money to produce products. It got to the point of absurdity, so in May 2015 our small deep-sea crab was adjusted to the price of the most expensive Kamchatka crab, customs duty was increased by 6.5 times. The inspectors often did not react to the fundamental arguments and presented calculations, and we were forced to go to court. Over the past four years, the customs value was inflated on 169 product declarations. Moreover, in 68 cases, after additional verification, customs independently accepted our original price. Due to customs adjustments of the remaining 101 declarations towards overestimation, the company won all lawsuits. Considering the charge stated in the press release, “understating the value of products,” and the four-year period indicated by customs in the charge, this will be the 170th attempt to increase the customs value of products, but over the entire four-year period.

There is also a negative side to these actions that have become a system. By inflating the cost of products, customs “withdrew” 123 million rubles from the company’s turnover. The delay in repayment based on a court decision averaged up to 9 months and during this period the company lost its earned funds. All this looks especially strange and unjustified against the background of the fact that all these years the same products were declared, while the price was either accepted without adjustments, or after an additional check, customs independently accepted the original price. Taking into account all these checks, including court decisions, the renewal and re-raising of questions regarding the customs price of our products looks very strange.

This is a clear abuse of law, since the reasonableness of the prices and their compliance with the terms of delivery have already been verified and, regardless of the basis for the verification, the prices will be confirmed again.

The company's staff and management do not understand why arbitration disputes and positive court decisions, which established in trials that the customs value established by the company was real, led to such decisions regarding the enterprise. It turns out that now the customs office, through its actions, is calling into question the court’s decisions, but the civilized way to defend your point of view is to file an appeal to a higher authority. But this was not done, in our case the court made decisions on the cost of products for the last four years, and customs agreed with the court decisions, confirmation is the return by customs to Vostok-1 of the overcharged payments. These are documentary facts and we can present all the documents.

The criminal case initiated against a company with more than 25 years of history in the fishing industry and high authority in the industry brought significant reputational losses to the company. 730 employees of the enterprise express concern about the current situation. In this situation, we are forced to freeze the project aimed at creating a new business within the Free Port of Vladivostok.

Reference: At the end of 2016, JSC Vostok-1 caught 31.2 thousand tons of aquatic biological resources, including 8,720 tons of deep-sea crab (a record catch for the company), income tax amounted to 148 million rubles. (more than 1.5 times higher than in 2015), and with such results, how can one say that the company has low prices or sells its products poorly?

We ask the leadership of the Far Eastern Customs Department and the prosecutor's office to take control of the case so that the investigation is objective and unbiased.

PAYMENT OF SHIP CREWS

The enterprise has a new system of remuneration for crew members. The average earnings when fulfilling the plan, regardless of the time of year, the cost of the fishery and other influencing factors, is:

  • rank and file from 1500 US dollars per month,
  • ship specialists in the range of 1800-7000 US dollars per month,
  • captains - from 7,000 US dollars per month.

The enterprise's vessels operate in foreign navigation mode, crew members are paid travel allowances in the form of daily allowances in foreign currency or foreign currency in exchange for daily allowances according to the standards established by the Russian Government.

Salaries are paid “openly”, with contributions to the Pension Fund. Payment of 80% of the basic earnings is made immediately after the sale of products and receipt of funds for it, approximately twice a month. The money is transferred to a bank salary account with the ability to withdraw money using a bank card - this solves the problem of the sailor’s family receiving money. The rest of the basic salary and bonuses are paid within 2 weeks after the end of the voyage.

Special bonuses are provided for employees who continuously work at the enterprise; in particular, employees are paid a bonus “for years of service” annually.

In addition, a package of additional social support and incentive measures is provided for crew members: life and health insurance, social compensation and payments, tuition fees, payment for trips to children’s camps, etc.

WORKING CONDITIONS

The enterprise carries out year-round fishing: deep-sea crabs off the coast of Primorye and Sakhalin; longline fishery for cod, halibut and grenadier in the Sea of ​​Okhotsk and Bering Sea.

The ships create the most comfortable conditions for crew members. The duration of the voyage is 4 months, which allows minimizing the psycho-emotional stress caused by isolation from family and shore life.
